Hearings have concluded in the FWC’s Family and Domestic Violence Leave Review and the Full Bench has reserved its decision. The Review is considering whether award-covered employees should have paid family and domestic violence leave entitlements and, if so, how many days per annum. Ai Group has played a leading role in representing employers in the case.

The FWC is hearing a major work value case in which the unions are seeking a 25 percent increase in wages under the Aged Care Award, the Nurses Award and the Social, Community, Home Care and Disability Services Industry Award. The unions are arguing that the work of the employees should be re-valued given changes that have occurred to the work over the past 25 years. If the unions are successful, there is the risk that the unions will pursue work value cases in many other industries.

There have been a number of recent FWC decisions relating to an employee’s refusal to take the COVID-19 vaccination in accordance with a Public Health Order.
