Does compassionate leave come out of personal/carer’s leave entitlements?

No. Compassionate leave is separate from and can be taken in addition to an employee’s personal/carer’s leave entitlements.

Under the National Employment Standards, employees (other than casuals) are entitled to up to two days of paid compassionate leave per each ‘permissible occasion’. Casuals are entitled to two days unpaid leave per occasion.

A 'permissible occasion' is defined as:

  • when an employee spends time with a member of their immediate family or household who sustains an illness or injury that poses a serious threat to their life; or
  • the death of a member of the employee’s immediate family or household.
