Long service leave (LSL) entitlements are dealt with in the National Employment Standards (NES), which partially preserve federal award entitlements that existed on 31 December 2009. Where federal award-based entitlements do not apply, state legislation provides LSL entitlements. The information in this article regarding LSL for Western Australian employees should be read subject to the explanation of the LSL arrangements in the NES.
Note that the Long Service Leave Act 1958 (WA) (the Act) was significantly varied effective from 20 June 2022. The amendments to the Act affect the way LSL can be taken, what absences counts towards continuous employment, and clarify how employee’s pay should be calculated where hours or pay vary.
