The various categories of employment in Australia exist within a complex legal framework that consists of a number of elements including the contract of employment, the award system, minimum legislated entitlements (and in particular the National Employment Standards, or the 'NES'), and enterprise agreements.
In addition to meeting minimum conditions, it is critical that organisations familiarise themselves with their rights and responsibilities when it comes to the areas of privacy and employee records.
In this section the various types of employment and minimum conditions for employees are discussed along with the interaction between the NES, industrial instruments and common law contracts. Employer obligations for employee records and privacy are also outlined so that organisations can be confident that legislative requirements are met.
