One of the most difficult employee relations issues is the management of ill and injured workers.  This is because of the extensive legal protections afforded to these workers under legislation dealing with discrimination, general protections, unfair dismissal, bullying, privacy and work health and safety.  Failure to navigate these various protections, particularly when dismissal is being contemplated, can be costly.

This practical half day workshop will cover the following: 

  • Outline the range of employment law obligations in relation to ill and injured workers, including workers with mental health problems 
  • Recognise measures to accommodate an employee's impairment during disciplinary and performance management processes 
  • Determine when to obtain and how to use medical information about employee incapacity 
  • Develop and apply a legally-compliant process for managing an incapacitated employee through to termination of employment
