The National Employment Standards (NES) in the Fair Work Act 2009 require an employer to pay several employee entitlements on termination of employment. Depending on the circumstances of the termination, an employer may be required to pay entitlements for:

  • Notice of termination
  • Annual leave
  • Long service leave
  • Redundancy pay

This checklist is intended as a guide to assist employers with the process of calculating payments to an employee on termination of their employment.
