This Summary covers the changes made to the Fair Work Act 2009 which remove the requirement for a union official to hold a Fair Work entry permit when entering workplaces at the request of and to assist a Health and Safety Representative (HSR). These changes were operative from 15 December 2023.
Union officials entering workplaces in these circumstances may however need to comply with additional and separate requirements under applicable work health and safety (WHS) legislation. This Summary does not address any additional WHS requirements
