This Summary provides an overview of the changes to the meaning of an ‘employee’ and an ‘employer’ for the purposes of the Fair Work Act 2009, and consequently the meaning of an independent contractor.

These changes largely commence from 26 August 2024. Changes to the sham contracting provisions, which commenced on 27 February 2024, are also dealt with.
