On December 2022, the Fair Work Legislation Amendment (Secure Jobs, Better Pay) Bill 2022 (Cth) (Amendment Act) was passed by the Commonwealth Parliament and received Royal Assent on 6 December 2022.  The Amendment Act introduces major changes to the Fair Work Act 2009  (FW Act) that  include the imposition of new obligations on employers in relation to employee requests for flexible work arrangements. The provisions are underpinned by a new ability for the Fair Work Commission (FWC) to deal with disputes in relation to matters associated with the handling and denial of requests for flexible work arrangements, including by way of arbitrating such disputes and issuing enforceable orders in relation to such matters. Non-compliance with these provisions can also now expose an employer to substantial civil penalties. The changes will be operative from 6 June 2023. This summary provides an overview to the changes to flexible work arrangements introduced by the Amendment Act.
