The Australian Government has implemented significant changes to the workplace relations laws, including:

  • new rules around enterprise agreement making;
  • new intractable bargaining provisions;
  • new multi-enterprise bargaining;
  • limiting the use of fixed term employment contracts;
  • introducing new employer obligations pertaining to matters including flexible working arrangements, pay secrecy clauses and unpaid parental leave;
  • new definition and provisions for casual employment;
  • new “right to disconnect”;
  • changes to union right of entry and delegates’ rights;
  • enhanced ‘Sham contracting’ provisions;
  • regulated labour hire arrangement orders - resulting in risks for labour hire employers and hosts;
  • new definition of who is an ‘employee’ (as opposed to a contractor); 
  • new 'wage theft' provisions;
  • new capacity for contractors to challenge unfair contract terms in the Fair Work Commission;
  • sweeping new powers for the Fair Work Commission to regulate: 
    • terms and conditions for “employee like workers” and contractors in the Road Transport Industry;
    • commercial arrangements in the Road Transport Industry Supply Chain.
