The New South Wales Industrial Relations Commission (IRC) has recently varied the temporary fuel surcharge rates (Surcharge Rates) payable under of the NSW Transport Industry - General Carriers Contract Determination 2017 (Contract Determination).

Members were previously advised that the IRC had inserted provisions in the Contract Determination requiring the payment of a surcharge in response to a significant rise in the price of diesel fuel in early 2022. The IRC conducts proceedings each month to determine whether the quantum of the Surcharge Rates should be either increased or decreased to reflect movements in the average price of diesel in the preceding month.
