NAT 108/20: High Court grants special leave to appeal the Federal Court’s casual employment decision:
On 26 November, the High Court of Australia granted special leave to WorkPac to appeal the decision of the Full Court of the Federal Court in the WorkPac v Rossato case. The case concerns the meaning of a ‘casual employee’ under the Fair Work Act and the ability of an employer to offset any casual loading that has been paid against any annual leave and other entitlements of permanent employees. The appeal will be heard next year with a decision likely to be handed down in the second half of the year.
