NAT 015/19: Federal Court decision on personal/carer’s leave accruals:
On 21 August, the Full Court of the Federal Court handed down a split 2-1 decision in the Mondelez v AMWU case concerning the quantum of personal/carer’s leave that an employee is entitled to under the Fair Work Act.
The judgment of Bromberg and Rangiah JJ is inconsistent with widespread industry practice and will have substantial cost implications for a large number of employers if the judgment stands.
