In New South Wales, the Surveillance Devices Act 2007 (SD Act) provides general restrictions on the use of surveillance devices which apply to all people. The Workplace Surveillance Act 2005 (WS Act) imposes additional obligations on employers conducting visual, tracking or computer surveillance of employees.

NSW has one of the most prescriptive surveillance regimes in Australia, with strict requirements for notice, signage and policies before surveillance is introduced in a workplace.
