This letter is to be used by employers when terminating an employee’s employment due to redundancy. The letter can be altered to suit the situation. If the termination is due to performance or conduct, then please use the Notice of Termination of Employment Letter.

The National Employment Standards (NES) provides for redundancy pay for all eligible full-time and part-time employees of up to 16 weeks, depending on their length of service. The employee must be employed by an organisation that is not a small business employer and, under the NES, various other exclusions apply. Redundancy entitlements can also exist under a Modern Award an enterprise agreement, organisation policy or even an individual employee’s contract of employment.

Under the NES an eligible employee is entitled to notice of termination, or payment in lieu, of between one week and five weeks depending on their length of service and age.
