Before hiring an employee to perform the work of an employee who is on parental leave the Fair Work Act 2009 (the FW Act)  requires employers  to tell the replacement employee that:  the engagement is temporary; the employee who is on leave has a right to return to work at the end of the leave; and the employee and the employer may have a right to cancel or end the leave early in some circumstances (e.g. stillbirth or infant death).
