The National Employment Standards (NES) confirm the traditional entitlement in Australia of four week’s paid annual leave for employees other than casuals. The NES sets out all the rules relating to the annual leave entitlement along with the availability of an extra weeks’ leave (five weeks in total) to certain shift-work employees.

Notwithstanding the significance of the annual leave provisions in the NES, it is important to bear in mind that modern awards and enterprise agreements can also contain annual leave provisions that supplement the NES.
