Many modern awards now contain new rights for employers and employees in relation to annual leave. These variations arose from the Annual Leave Common Issues Case, part of 4 Yearly Review of Modern Awards.

One of the variations deals with the cashing out of a particular amount of annual leave by agreement between an employer and an employee.

Note that the National Employment Standards and modern awards contain restrictions on the amount of leave that can be cashed out, such as maintaining a minimum accrual of 4 weeks’ leave and, under modern awards, cashing out no more than 2 weeks’ leave per year. It is important to check the industrial instrument that applies to the employee before agreeing to cash out leave.

The following Agreement to Cash Out Annual Leave Form is based on an example provided within modern awards, however, there is no requirement for this format to be used; it is an example only of how a cashing out agreement may comply with award requirements.
