The legal foundation of every employment relationship is the contract of employment.  The contract is regarded as a contract of personal service between an employer and an individual employee whereby the employee agrees to perform work in return for remuneration from the employer.  The contract gives rise to rights and obligations that may be enforced by either party through the common law courts.   It is therefore often referred to as a ‘common law employment contract’.
