Decision of DP Clancy re AGL

"The Australian Industry Group welcomes the Order issued today by Senior Deputy President Clancy of the Fair Work Commission (FWC) to terminate the industrial action of the Communications, Electrical and Plumbing Union (CEPU), and the industrial action taken in response by AGL," Ai Group Chief Executive, Innes Willox, said today.

"Under section 266 of the Fair Work Act, the parties now have 21 days to reach agreement (which can be extended to 42 days by agreement between all parties).  If agreement is not reached within this period, a Full Bench of the Commission will arbitrate.

"The FWC’s Order protects businesses in Victoria and other States from the widespread disruption that would have potentially resulted from the shutdown of the Loy Yang A power station and mine.  It is pleasing that the Victorian Government moved quickly to apply for the Order, and that the FWC promptly made the Order," said Mr Willox.
